Welcome to our website. By using our site, you agree to comply with and be bound by this Terms of Use Agreement (“Agreement”). If you do not agree to all of these Terms of Use, do not use this site. The term “Canadian Blood Services” or “us” or “we” or “our” refers to Canadian Blood Services, the owner of the website. The term “you” refers to the user or viewer of our website.

1. Acceptance agreement

You agree to the terms and conditions, without modification, outlined in this Agreement with respect to our site blood.ca/mystory (the “Site”). This Agreement may be amended by us from time to time without specific notice to you, by updating this posting. This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement.

2. Eligibility

You must be at least 18 years old to upload, publish or display (collectively, “post”) a text, story, images, photos, videos or any other materials (collectively, “Content”) on our Site.

3. Proprietary rights

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are the proprietary property of Canadian Blood Services, and are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) Canadian laws. Canadian Blood Services hereby grants you a limited, revocable license to reproduce and display content from our Site (excluding any software code) solely for your personal, non-commercial use in connection with viewing our Site.

You represent, warrant and agree that you own the rights in the Content that you post on our Site. Canadian Blood Services does not claim any ownership rights to the Content that you post on or through the Site. After posting your Content to our Site, you authorize and direct us to make copies thereof as we deem necessary in order to facilitate the posting and storage of the Content on the Site.

By posting Content to any part of the Site, you automatically grant Canadian Blood Services an irrevocable, perpetual, non-exclusive, fully paid, royalty-free, transferable, sub-licensable and worldwide license to use, copy, reformat, translate, excerpt, reproduce, publicly display and distribute such Content on, or in connection with, the Site or in any social media services.

You may remove your Content from our Site at any time except (i) to the extent you shared it with others as part of the Site and they copied or stored it and (ii) for the reasonable time to remove it from the Site. If you choose to remove your Content, please contact us at mystory@blood.ca. However, Canadian Blood Services may retain archived copies of your content.

You understand that by posting Content on any part of the Site, it means that you are allowing the public to access and use that information, and to associate it with you (i.e. your name, pictures and story).

4. User content

You are solely responsible for the Content that you post on our Site, or transmit to or share with others. You may not post content on our Site that you did not create or that you do not have permission to post. You may not post content on our Site on behalf of another individual or entity unless you are authorized to do so. You understand and agree that Canadian Blood Services may, but is not obligated to, review the Site and may delete or remove, with or without notice, any Content in its sole discretion, for any reason, that in the sole judgment of Canadian Blood Services violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of others.

5. User conduct

You understand that the Site is available for your personal, non-commercial use only. You represent, warrant and agree that Content posted by you will not violate or infringe upon the rights of any third party, including copyright, trademark, privacy, personal or proprietary rights, or contain libelous, defamatory or otherwise unlawful material.

In addition, you agree not to use the Site to:

  • post any Content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
  • post any photos or videos other than those of a personal nature that: (1) are of you or your friends and family, or (2) are taken by you, your friends or your family;
  • impersonate any person or entity, or falsely state or otherwise misrepresent yourself, or your affiliation with any person or entity;
  • post any unsolicited or unauthorized advertising, solicitations, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitations;
  • post on the Site any private, confidential or sensitive information of any third party, including, without limitation, any person’s health information, health card information, credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses;
  • intimidate, harass, defame, stalk, bully, abuse, threaten, impersonate or intimidate another;
  • post any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • post Content that would constitute, encourage or provide instructions for a criminal offence, violate the rights of any party, or that would otherwise create liability or violate any local, provincial, territorial, federal or international law; and
  • post Content that, in the sole judgment of Canadian Blood Services, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Canadian Blood Services or its users to any harm or liability of any type.

6. Disclaimer

Canadian Blood Services is not responsible for and makes no warranties, express or implied, as to the Content posted on the Site, or the accuracy and reliability of the Content posted on the Site.

7. Release and indemnity of Canadian Blood Services

You agree to indemnify, defend and hold us and our agents, officers, directors, employees, subcontractors, successors, assigns, partners, third party suppliers of information and documents, advertisers, product and service providers, and affiliates harmless from any liability, loss, claim and expense, including reasonable legal fees, related to your violation of this Agreement or use of the Site. You also agree to release and hold harmless Canadian Blood Services from and against any and all liability, claims damages, actions, and costs, arising out of or in connection with your use, review or reproduction of the Site.

8. System integrity

You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the Site. You may not take any action, which imposes an unreasonable or disproportionately large load on Canadian Blood Services infrastructure.

9. Website linking

Links to other websites or references to other organizations, products, services or publications do not constitute endorsement or approval by Canadian Blood Services and Canadian Blood Services makes no representation whatsoever about any other website which you may access through this one. Canadian Blood Services cannot and does not warrant the accuracy, completeness, timeliness, non-infringement, merchantability or fitness for a particular purpose of any information available through these links and disclaims and opinions expressed on such sites.

10. Limitations of liability

Canadian Blood Services shall not be liable to you and/or any third party under no circumstances for any damages of any kind arising out of or relating to the use of, or reliance upon, our Site including, but not limited to, any lost profits, lost opportunities, special, incidental, indirect, consequential or punitive damages, regardless of your advice to the contrary.

11. Unlawful activity

We reserve the right to investigate complaints or reported violations of this Agreement and to take any actions we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information.

12. Disputes

Your use of the Site and any disputes arising from it is subject to the Terms of Use as well as our Privacy Policy.
